Does it cost anything to file a complaint?
No. Filing a complaint with CREO is free.
Do I need a lawyer?
No. You do not need a lawyer to file a complaint, but you may choose to hire one at your own expense.
How do I start the process?
You can begin by contacting CREO using the myKCMO app, email, phone, mail, or by visiting the office.
Staff will review your situation and let you know if your complaint is covered.
If it is, you will be asked to complete a questionnaire.
Will the employer or business know I contacted CREO?
If you do not file a complaint, your information is not shared. If you file, CREO will send a copy of your formal complaint within 10 days. The business or employer only receives a copy of the Charge of Discrimination and will not learn all of the details you provide to CREO. In addition, the business or employer is prohibited from punishing you because you filed a discrimination complaint.
How long do I have to file a complaint?
You must file within 180 days of the incident.
In some employment cases, this may be extended to 300 days if your complaint is also filed with the EEOC.
What happens after I file?
- The employer or business is notified
- They are asked to respond to your complaint
- You may choose mediation to try to resolve the issue
- CREO investigates and gathers evidence
- A final decision is issued
- Further action may be taken if discrimination is found
How long does an investigation take?
There is no set timeline. The length of time it takes depends on the circumstances of your individual case. In some instances, discrimination complaints are dismissed soon after they are filed because there is no evidence of illegal treatment or because they are not covered by our laws. In other cases, CREO needs to gather additional information before we can make a decision.
Can I withdraw my complaint?
Yes. You can withdraw your complaint at any time by contacting CREO in writing.
Can my employer retaliate against me?
Your employer is prohibited from retaliating against you, treating you differently, or harassing you because you file a discrimination complaint with CREO, even if it turns out that the conduct you were complaining about was not illegal. However, you are not excused from continuing to perform your job or follow your company's legitimate workplace rules just because you file a complaint with CREO.
